Welcome to the Bharatcabs Pilots App. These Terms and Conditions (“Terms”) govern your access to and use of the Bharatcabs Pilots App (the “App”) provided by Bharatcabs.com (“we,” “us,” or “our”). By registering or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility

To use the Bharatcabs Pilots App, you must:

  1. Be at least 18 years of age.
  2. Possess a valid driver’s license recognized in India.
  3. Own or have lawful access to a vehicle that meets our safety standards and is registered in your name or a business entity you represent.
  4. Provide accurate and up-to-date personal information and vehicle documentation as requested.

2. Account Registration and Management

  1. Account Creation
    You must create an account to use the App. You agree to provide true, accurate, and complete information during the registration process and keep this information up to date.
  2. Account Security
    You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any losses caused by unauthorized access to your account.
  3. Driver Verification
    As part of the registration process, you must submit documents including your Aadhar, driving license, vehicle registration certificate (RC), and insurance details. We reserve the right to verify your documents and conduct background checks.

3. Use of the App

  1. Service Overview
    The Bharatcabs Pilots App is a platform that connects you, the driver (“Pilot”), with customers seeking ride-hailing services. You acknowledge that Bharatcabs is an intermediary and not an employer. All drivers operate as independent contractors.
  2. Driver Obligations
  • You agree to provide safe, courteous, and timely transportation services to customers.
  • You must comply with all applicable laws, regulations, and traffic rules while providing services.
  • You are responsible for maintaining your vehicle in a clean, safe, and roadworthy condition.
  • You agree not to engage in any illegal activities, harassment, or discrimination against customers or others.
  1. Service Fee and Payment
  • You will receive payment for services provided through the App. The payment amount will be determined based on the rates set by Bharatcabs.
  • Bharatcabs reserves the right to deduct a service fee from your earnings. The service fee percentage will be communicated to you in advance and may be subject to change.
  1. Cancellation and No-Show Policies
  • You may cancel a ride request before it begins; however, frequent cancellations may lead to penalties or suspension of your account.
  • If you fail to show up for a scheduled ride, it may result in penalties, including suspension or termination of your account.

4. Intellectual Property

  1. Ownership
    All content, logos, trademarks, and intellectual property associated with the Bharatcabs Pilots App are owned by Bharatcabs.com. You are granted a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
  2. Restrictions
    You agree not to reproduce, distribute, modify, or create derivative works based on the App or its content. You must not reverse engineer or attempt to extract the source code of the App.

5. Termination

  1. Termination by You
    You may terminate your account at any time by contacting us at Bharatcabs.service@gmail.com. Upon termination, your access to the App will be revoked.
  2. Termination by Us
    We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activities, or pose a risk to the safety of customers.
  3. Effect of Termination
    Upon termination, any outstanding payments owed to you will be processed according to our payment policies. However, termination does not absolve you of any liabilities or obligations incurred under these Terms.

6. Limitation of Liability

  1. Disclaimer
    The Bharatcabs Pilots App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee the availability, accuracy, or reliability of the App.
  2. Limitation
    To the maximum extent permitted by law, Bharatcabs.com shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.

7. Indemnification

You agree to indemnify, defend, and hold harmless Bharatcabs.com, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with your use of the App, your breach of these Terms, or your violation of any law or the rights of a third party.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [Your City, India].
